Himachal Pradesh High Court Orders Age Limit for Adventure Sports like River Rafting

Himachal Pradesh is considered a haven for adventure activities like trekking, river rafting, paragliding, bungee jumping, and many more. Lakhs of tourists visit this breathtaking state just to experience the adrenaline rush.

The Himachal Pradesh High Court has directed the Deputy Commissioner of Kullu to investigate and suggest a suitable maximum age limit for individuals participating in River Rafting, kayaking and other river sports in the state. Moreover, the court has emphasized the necessity for senior citizens to obtain a fitness certificate before engaging in these activities.

Under the leadership of Chief Justice M.S. Ramachandra Rao and Jyotsna Rewal Dua, the bench has mandated the setting of an upper age limit for individuals intending to partake in river rafting, kayaking and similar river sports. Additionally, they have stipulated that senior citizens engaging in these activities must present a Fitness Certificate. Furthermore, the bench has underscored the importance of possessing swimming skills, which may be deemed essential.

During this time, the court identified shortcomings in safety measures and pointed out that many rafting operators were not complying with Rule 11(b) of the Himachal Pradesh River Rafting Rules, 2005. This rule specifies that operators must have either two rescue rafts or a combination of one raft and a kayak.

After this observation, the court has instructed the Deputy Commissioner of Kullu to provide a report outlining the proactive steps taken to enforce these rules. Additionally, the court has requested information on the number of operators penalized for failing to comply with these rules in the past two years. The court has sought suggestions for additional effective measures aimed at preventing fatal accidents during rafting activities.

Building upon its previous directives, the recent decision by the court underscores the urgent need to enhance safety protocols in adventure sports. This heightened focus is in response to a tragic incident involving the premature death of a 65-year-old tourist.

In addition to stressing the requirement for senior citizens to present a Fitness Certificate before participating in adventure sports, ensuring the physical well-being and suitability of older individuals for such activities, the bench has tasked the District Magistrate of Kullu with conducting a thorough evaluation in this regard. The DM is instructed to formulate and propose appropriate recommendations concerning the assessment of senior citizens’ fitness for engaging in these thrilling activities.

Lahaul and Spiti: Lahaul and Spiti offers two routes for river rafting, one from Darcha to Udaipur and another from Tandi to Udaipur. However, only professional rafters are allowed for these routes.

Ravi and Saal Rivers in Chamba: The Chamba district is being developed and considered for the introduction of river rafting along with the mighty Ravi and Saal that flow through it. The state government and the tourism department are preparing to popularize this sport in the region.

Tattapani near Shimla: Tattapani is the only place for river rafting in Shimla, located 50 kms from the city. It offers rafting in the River Sutlej.
